This bill offers multitude changes to Title 21:
Section 1:
- Any person employed by the county election superintendent must be a citizen of the US;
Section 2:
- Unhoused individuals are to register to vote using the county courthouse address;
- Provides additional language on determining a person’s residence;
Section 3:
- Removes automatic voter registration updates through the DDS and makes it an option;
Section 4:
- Addresses mass voter challenges;
- Increases language on probable causes for how an elector can have their vote challenged;
- Allows the USPS’s change of address program data to be utilized as a tool in vote challenges and verifying a person’s jurisdiction;
Section 5:
- Vote challenges to not be governed by Chapter 11 of Title 9, the Georgia Civil Practice Act and evidence for a challenge should just be “persuasive and reliable”;
Section 6:
- Creates the option for an election supervisor to choose to use paper ballots for any nomination or election of any candidate or office with review and approval of State Election Board;
Section 7:
- Removes attorney fees for any non prevailing party in an election contest faith as long as it was in good faith;
Section 8:
- Any person, including a poll worker and now added language of election official, who willfully prevents a poll officer or other election official from performing their duties shall be guilty of a felony;
Section 9:
- Makes a county election superintendent at risk of a misdemeanor if accused with willful neglect or refusing to perform their duty.
