HB 479 – Repeals the citizens arrest statute

Sponsored by: Rep. Bert Reeves et al.


  • Repeals the statute allowing for arrest by private persons.
  • Allows a law enforcement officer to make an arrest outside of the jurisdiction of his employing agency if
    1. an offense is committed within his presence or immediate knowledge,
    2. he is immediately pursuing an individual for an offense committed in his agency’s jurisdiction, or
    3. he is assisting another officer within his own agency’s jurisdiction.
