Palacios v. Kemp
Ms. Maria Palacios, a candidate for state legislature in a district that is 60% people of color with a 43% Hispanic population. The ACLU of Georgia defended her against baseless challenges to her citizenship qualifications.
The ACLU of Georgia sued the Secretary of State in Superior Court of Fulton County, appealing the Secretary of State’s decision to kick Ms. Palacios off the ballot.
The Fulton County Superior Court ruled that Maria Palacios of Gainesville is not eligible to run for a state House of Representatives seat even though she has lived in Georgia since 2009 and became a United States citizen in 2017.
The American Civil Liberties Union of Georgia appealed this decision to the Georgia Supreme Court. However, the State Supreme Court declined to hear the appeal.
