In an effort to guide school districts across the state about immigration enforcement, we sent a letter outlining their legal obligations to protect students.
The ACLU of Georgia and Asian Americans Advancing Justice-Atlanta are raising alarms about the impact of sweeps on school campuses. ICE previously maintained a “sensitive locations” policy that kept our classrooms off the federal government's radar. That good bit of regulation is no longer being followed, but the change does not affect the right to an education for immigrant youth, or the duty schools have to protect students’ constitutional rights.
Our guidance to school outlines those rights and responsibilities, including:
- Schools don’t have to allow ICE agents to enter school property that is not otherwise open to the public, unless the agents have a warrant to justify their presence.
- Students and families should not have to provide information about their immigration status to their schools.
