“The ACLU of Georgia believes voting should be accessible for every citizen, and the process to remove voters from rolls or flag them as challenged voters should always be in strict compliance with state and federal law. Bare-bones challenges to voters in the immediate run-up to an election, places an undue burden on voters and on election workers.” — Caitlin May, ACLU of Georgia Voting Rights Staff Attorney.Background
Hundreds of insufficient voter challenges have been filed in recent weeks in Cobb County. Election officials should not continue to investigate these challenges because:- These challenges do not meet the probable cause standard required to sustain a challenge to an individual’s right to vote in Georgia;
- The National Voter Registration Act prohibits systematic removals of voters within 90 days of an election; and
- State law gives a clear two-step process for these challenges, which does not include election workers doing their own research into the challenges because challengers failed to do so themselves. The Board must determine whether the challenges, on their face, establish the requisite probable cause.
